TERMS & CONDITIONS

Acceptance of Terms

The Chocolate Fish Merino website, (the "Website") and all of its content and services, is owned and/or operated by Chocolate Fish Merino LLP.  Your use of this Website is conditional upon your acceptance without modification of the terms, conditions, and notices contained or referenced in this Terms of Service Agreement (the "Agreement").


Order Acceptance Policy

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Chocolate Fish Merino  reserves the right at any time after receipt of your order to accept or decline your order for any reason. We may require additional verifications or information before accepting any order.

Orders can only be accepted if placed using the latest update of our website, and we reserve the right to refuse orders placed on over old pages where prices or stock availability differs from the latest version.  We therefore strongly recommend that before adding items to the shopping basket, book-marked or cached pages are refreshed or reloaded.

Please note that we do not accept orders from email addresses that use Spam Filter programs that require manual confirmation.


Special Orders

  • May only be placed within the time limit specified.
  • Can only be accepted if placed separately from any orders for goods in stock on our website.
  • Should a special order be placed with an order for item from stock, we will invoice for the extra postage required and the special order will only be accepted when this is paid.
  • Changes to order may be made by the customer at any time up to the final date allowed for placing of orders.
  • We reserve the right at any time after receipt of your order to accept or decline your order for any reason.


Trades Description

All specifications are those quoted by manufacturers and every care is taken to ensure that all descriptions are correct, but slight  variations may occur within accepted trade tolerances.

Every effort has been made to ensure that the colours on this web site are accurately reproduced, however  variations may occur due to the reproduction process and individual monitor settings, for which we apologise but can take no responsibility.


Typographical Errors

In the event content on the Website contains incorrect information, or a product is listed at an incorrect price, due to typographical errors or error in pricing information, Chocolate Fish Merino shall have the right to refuse or cancel any orders placed for products listed at the incorrect price. Chocolate Fish Merino shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Chocolate Fish merino shall immediately issue a credit to your credit card account in the amount of the incorrect price.


Dispatch - Orders from stock

We do our best to dispatch all orders within 2 working days of receiving them but do not normally send orders out on Saturdays unless specifically requested.  We cannot however guarantee delivery times as these are beyond our control.  The statutory delivery time allowed by Distance Selling Regulations is 30 days.


Dispatch - Special orders

Special orders come direct to us from New Zealand and we are dependent on the shipping company as to how quickly these will get to us.  We therefore can only give an approximate delivery date.


Cancellation

Under UK Distance Selling Regulations the customer has 7 days from their receipt of the goods to cancel their order.  Orders can only be cancelled by by the customer by written instruction via letter or email. Goods must be returned in a new and unworn condition at the customer’s expense.   


Shipping  

It is the buyer's responsibility to provide an address suitable for delivery where the item can be checked and signed for. The customer must therefore ensure the address and postcode entered during checkout is correct.

A signature given at the address supplied by the buyer will be taken as proof of delivery.

Orders sent using Airsure do not require a signature on delivery and can be tracked to destination. This is accepted as proof of delivery.

Orders sent using Royal Mail International signed-for (ISF) can only be tracked within the UK. We therefore cannot  take responsibility for orders once they have been passed into the hands of another postal service.

Orders for which a signature has been given will be deemed as being delivered.

Further delivery costs will be incurred if the address supplied is incorrect and the delivery cannot be completed. Items returned to us as "undeliverable" by the carrier, will not be re-dispatched until extra postage costs have been paid in full.

If the carrier has delivered to an address other than the one given, then the customer should claim against the carrier. If the carrier provides proof (i.e. a signature) that the order was delivered to the specific address provided by the customer  and that someone else within that address signed for it, then the responsibility lies with the customer to raise the loss of the item with the Police as stolen goods.

We do not replace or refund for any order for which delivery has been confirmed by the Carrier.  

Please note that any attempt at cancellation of payment or chargeback due to a claim of non-delivery when a proof of delivery signature has been given to the Carrier, may be treated as an attempt to defraud.


PO Box addresses

We are unable to deliver to PO Boxes, so any delivery to such an address will not be processed.


Returns & Refunds

We hope that any product that is purchased through Chocolate Fish will meet all of your expectations.  If, however you decide the item purchased does not suit, you may return it for a refund of the purchase price.

Where payment has been made through WorldPay, refunds will be made through WorldPay and should appear on your next credit card statement.  Where payment has been made through Paypal Express, refunds will be made via Paypal Express.  Please note that we can only make refunds to the original purchaser.  For payment by cheque, these will be refunded by company cheque.   


UK & EU Customers:

  • Must notify us by email in advance of any return.
  • The customer is responsible for payment of the postage cost of return.
  • The goods must be returned in a saleable condition, unworn, with tags intact.
  • The goods must be returned within 21 days of receipt.
  • We advise all returns are made using a registered service as we cannot take responsibility for non-delivery.

Customers outside the EU:

  • Must notify us by email in advance of any return.
  • The goods must be returned in a saleable condition, unworn, with tags intact.
  • We advise all returns are made using a registered service as we cannot take responsibility for non-delivery.
  • The customer is responsible for payment of the postage cost of return.
  • Returns from countries outside the EU must carry a customs declarations stating that the goods are a return.  Should we be charged UK tax and duty on returned goods we will deduct this amount from any refund exchange due to the customer.
  • The goods must be returned within 21 days of receipt.

The above policy applies to all goods except items in our Bargain Basement.  Discounted or sale products are excluded from our general returns policy.  Clearance and sale items may only be returned within the 7 days allowed by statutory Distance Selling regulation by prior notification and agreement.
